Terms and conditions for Part Time Courses(Last Updated: 26th Sep 2010)
1. Student has the right to change the start date by providing a minimum of seven days notice, in writing or via email to: admin@london-college.com. Any requests received after this date, may not be processed. This is due to limited class size and availability
2. Once a module /part of a package/course have started, refund will not be available for any part of the course.
3. Course fees exclude exam fees, unless these were paid for separately.
4. Student has the right to claim for a refund, if applied for and received in writing within seven days of the enrolment date. This does not apply for courses starting within a week of enrolment. An administration charge of £230 is applicable if the refund is approved.
5. We reserve the right to refuse access to any student who has failed to make full payment, is rude and disruptive, bullying and/or harassing our staff and/or other students. All students are required to respect and treat others as equal, and we will not tolerate acts of discrimination or inappropriate behaviour of any kind, in line with the relevant legislation.
6. We make every possible effort to run all the courses as advertised. However, we reserve the right to cancel subjects or courses at any time if they prove to be non viable, or, for any reason which lies outside the College's control; and to alter aspects of the course such as fees, trainer, dates, times, location and reschedule classes if this becomes necessary. Short courses do not always run consecutively; always check available dates with our admin or the website.
7. The College collects personal information when you register with us. We will use this information to provide the service requested, contact you in relation to your course/send you marketing information. The College will not share your information with any external group/organization, except for cases of prevention of fraud or illegal activities.
8. Please note, these terms are subject to change/review with no prior notification. The College reserves the right at all times to vary, change, alter, amend, add to or remove any of these items.

• All enrolments are made based on documents provided by the student. We have the right to confirm that these are genuine at any time, but it is the student’s responsibility to ensure that all documents provided are genuine. We may cancel the course at any point if we find that the student has used deception in obtaining a registration/enrolment or is in breach of the current UK immigration rules. Any fees paid will not be refundable either.
• As an overseas student, course attendance is compulsory at all times during term times and we will be monitoring this and notifying the UKBA of missed sessions without our agreement/authorization. We also reserve the right to look into student repeated lack of attendance due to illness-we may cancel the course if we consider that they may not be able to complete their course and/or achieve adequate results in their exams and any fees paid will not be refundable.
• Course fees do not include the cost of books/materials/exam fees relating to the course. Exams are compulsory for all students prior to progressing to the next level of their course-failure to provide exam results, will result in the course being cancelled, with no right to a refund, and the College refusing to extend/renew sponsorship.
• We reserve the right to disclose information held on all of our students to the UKBA and other relevant authorities when requested to do so.
• Students who take unauthorized leave/holidays may be reported and their sponsorship be cancelled.
• All students are urged to always advise the UKBA website and be informed of all new regulations applicable. We will from time to time provide updates to our students of any changes, but cannot guarantee this.
• Once a student has been issued a Certificate of Acceptance for Studies (CAS), the student is bound by our Terms and Conditions of studying, and unless the College cancels this, the student has no right of cancellation.
• We will not issue a CAS for visa extension if the student’s attendance is not satisfactory and in line with the minimum requirements, or if there is no progression/exam results provided.
• Please note that the fee for Certificate of Acceptance for Studies (CAS), is payable by the student. The college reserves the right to deny issuing Certificate of Acceptance for Studies (CAS), until the student has paid for it.
• Cancellation of enrolment/registration can only be accepted within 7 days of enrolment/registration, provided the College has not issued a CAS. This request needs to be received in writing and it will be considered based on the applicable terms. Refunds, if approved, will attract a fee of £1500
• Once a CAS has been issued, or the minimum cooling off period has expired (whichever is the earliest), we will not be authorizing refunds or transfer for any fees/part of tuition paid.
• Students who receive a visa and fail to enrol with the College within the set time limits will be reported to the UKBA and their sponsorship will be withdrawn- any fees paid will not be refundable/transferable in any such circumstances.
• Student fees are payable in advance of course start. If we have agreed payment by instalments, these need to be adhered to, as, failure to meet the instalments on due dates will result in student being denied access to classes/College facilities and in some cases will result in course cancellation.
• Students must ensure that correct information/documentation is provided when applying for a visa, as the College will not accept responsibility for a refusal caused by the student providing incorrect and/or fraudulent documentation or fails to obtain points for the maintenance part. In cases where the visa/entry clearance is rejected for failing to achieve points for the maintenance(10 points), or have applied after the CAS has expired, the re issue of CAS will attract an additional charge of £750, along with the standard CAS re issue fee. The standard CAS re issue fee is £1000.
• The College does not provide accommodation, but students are advised to ensure that they find a suitable place to live, which will allow them to travel to College on a daily basis with ease. Lateness or inability to attend classes due to inaccessibility will not be tolerated and will result in attendance being affected.
• We reserve the right to refuse access to classes to any student who is rude, disruptive, bullying and/or harassing our staff and/or other students. • It is the student’s obligation to provide the College with up to date contact details at all times. Any change of circumstances/contact details need to be provided to us immediately. This will ensure that we can have good communication links at all times.
• The College shall not accept any liability of any kind or nature, whether in contract or in tort or otherwise howsoever for any personal injury, loss, damage, liability or expenses suffered or incurred by the student (as to which the student expressly waives any right of recovery) or by any person arising directly or indirectly or in any manner howsoever out of any action taken by us if deemed appropriate, including but not limited to withdrawal of a student's sponsorship at any point or when requested to do so by a UK authority/Government department(such as UKBA/Immigration Control, Embassy/High Commission, a Court or the Police) raising concerns while carrying out investigations and/or based on their findings. In such cases, the College reserves the right at their absolute discretion to reject/overturn a decision to accept a student onto a course at any stage of the application or booking process and shall be under no obligation whatsoever against all actions, proceedings, costs, claims and expenses so arising.

• The student and/or their representative are responsible to update the College of their visa status/date of arrival in the UK/any sick notes for lack of attendance (within 7 days). Failure to provide this information as soon as it is received may result in the student being reported/sponsorship withdrawn. In such cases, no refund of fees will be authorised and the re issue of documents will incur additional fees. The College cannot be held responsible if the student is reported due to them failing to provide information within the specified time limits.
• It is the student’s obligation to check and update themselves with the latest UK immigration rules BEFORE applying for their visa. The college will not be authorising a refund, if the applicable rules are ignored.
• College reserves the right to withdraw sponsorship at any time, where, amongst others the student was found not to be complying and/or meeting the requirements of their visa. Where the sponsorship is withdrawn, no refund will be made.
• All refund applications for overseas visa refusals will be undergoing verification checks with the relevant British Embassy. This will take an average of 90 days from the date of refund application, to the date of a decision/response to be issued; depending on the time it takes for the overseas Embassy to reply to us. All refund applications need to be received within three months of the visa rejection; any applications made after this time will not be considered.

Refund Policy
1. If you wish to apply for a refund, we need to receive your written request/completed refund application form via email and/or post. You may also complete a form in person and hand to our admin department for consideration.
2. Once a module /part of a package/course have started, refund will not be available for any part of the course-we will however consider an exchange of a module for a fee as applicable. (Part Time enrolments)
3. All refund applications are processed/replied to within 28 working days from the date of receipt of the application. Once approved, an authorization form is sent, together with the decision letter. This form needs to be signed and returned to us, in order for us to proceed with refunding the approved funds. (P/T enrolments)
4. Student has the right to claim for a refund, if applied for and received in writing within seven days of the enrolment date (cooling off period). This does not apply for courses starting within a week of enrolment. An administration charge of £230 is applicable if the refund is approved (P/T enrolments)
5. Other than in the case of payment received being cash, all other refunds will only be returned to the original source/account that money was received from.
6. In some cases, such as where payment was received from an overseas account, it may take up to three months for the money to reach your account.
7. Cancellation of enrolment/registration can only be accepted within 7 days of enrolment/registration, provided the College has not issued a CAS. This request needs to be received in writing and it will be considered based on the applicable terms. Once a CAS has been issued, or the minimum cooling off period has expired (whichever is the earliest), we will not be authorizing refunds or transfer for any fees/part of tuition paid. (F/T enrolments)
8. All refund applications for overseas visa refusals will be undergoing verification checks with the relevant British Embassy. This will take an average of 90 days from the date of refund application, to the date of a decision/response to be issued; depending on the time it takes for the overseas Embassy to reply to us.
9. All refunds approved following a visa rejection(Full Time enrolments) will attract a £1500 administration fee and course fee calculated on a pro rata basis for each week elapsed from the start date of the course to the date of the College being informed of visa refusal. It is the responsibility of the student to inform the College of any decision by the Home Office. All communication needs to be in writing/via email to info@lsce.co.uk (this does not apply if the rejection was due to failure in achieving points for the maintenance part of the ECO, or where the student has provided incorrect and/or fraudulent documentation in their application)
In the case of a visa refusal, a refund will also not be granted if:
• The refusal is due to a student working more than the legal max amount of hours per week.
• The refusal is due to a student’s poor attendance, criminal activities, incorrect/invalid docs or progress results from a previous/current academic year or any doc that upon verification check is found to be incorrect/inconclusive/fraudulent
• If the student is at fault for submitting a late application and/or for not meeting all the Immigration requirements as per the applicable rulings and/or the General Grounds of Refusal.
• Original refusal Documents from the Home Office/Embassy are not provided.
• In cases where students have failed to register/take exams during the academic year
• The sponsorship is withdrawn
10. For all visa rejection refund applications, students or their representatives will need to apply within three months of the visa rejection, providing original documents from the H/O or Embassy. Any applications received after this time, will fall outside of the refund entitlement period.
11. Refund applications received after a course has started/CAS has been issued will not be approved under any circumstances.
